다. 미등록 외국인노동자와 외국인 산업연수생에 대한 차별대우가 만연한 현실을 개혁하기 위해서는 현행 제도의 보완으로는 불충분하므로 별도의 입법이 필수적이다. 따라서 「외국인노동자의 고용 및 관리에 관한 법률」에는 외국인노동자의 고용과 관리에 관한 내용과 절차를 규정하고, 노동자로서의 권리를 보장하고 그들의 인권 침해를 예방하기 위한 제도적 장치 등이 포함되어야 한다. 법률은 규제와 보호라는 양날을 지닌 칼과 같다.레포트 > 사회과학계열

고용허가제도를 실시하는 방법은 「외국인노동자의 고용 및 관리에 관한 법률」을 법제화하는 데서 찾아야 한다. 또한 경과 규정을 두어, 현행 산업연수생 사용업체에 대상으로하여는 기존 연수계약기간 만료 시까지 산업연수생의 고용을 인정하여야 할 것이다.
